Below we would like to present our general terms and conditions regulating the processing and execution of your purchases. At https://www.madebychiara.ch we offer you the exclusive purchase of madeby.chiara products.

The offers on our website www.madebychiara.ch are intended exclusively for consumers who conclude the purchase for a purpose that can be attributed neither to a commercial nor a professional activity.

1. CONCLUSION OF THE CONTRACT AND DELIVERY OF PRODUCTS
1.1 By placing an order, you declare that you are acting solely for private purposes.
1.2 By clicking on the "buy now" button you place a binding order with respect to the items contained in your virtual shopping cart. Once the order is transmitted, we will send you an e-mail with the order confirmation when the order is accepted by madeby.chiara production. The contract is concluded when the customer receives the order confirmation. 
1.3 Where the products covered by the order are not correct or delivered on time, there is no obligation for us to deliver the ordered goods. The assumption is that we are not responsible for the non-availability of the goods and that we have informed you about the situation in a timely manner. In any case, if the ordered goods are not available we will without any delay refund any amount already paid, if any.
1.4 We reserve the right not to accept an order or to cancel an order if it is placed through the use of software, robots, crawlers, spiders, any automated system or scripting and any use of third party services used to place an order on your behalf. We also reserve the right to cancel the sales contract if it is made for the purpose of scamming and/or reselling the products.

2. PRICES AND SHIPPING CHARGES 
2.1 The prices quoted at the time of placing the order are considered valid. The prices quoted are final and include VAT.
2.2 For "custom" products, flat rates are added for modifications that the customer can add (30.00 CHF VAT incl. for pockets, 50.00 CHF VAT incl. for embroidery and 50.00 CHF VAT incl. for designs), of course madeby.chiara reserves the right to ask for an increase in these rates in case of elaborate processing.
2.3 Prices of products sold by authorized retailers may vary and are not affected by any discounts applied on the online store www.madebychiara.ch
2.4 Shipping charges are covered by us, except where otherwise stated (see also the other terms of this clause 2.5).
2.5 For orders of CHF 199.00 or more, domestic shipping is free of charge. Orders below 199.00 CHF are charged a shipping charge of 9.00 CHF incl. VAT for domestic shipments and 15.00 CHF incl. VAT for international shipments to the European Union. The amounts depend on the size of the order, the handling of the shipment, and other services. 
2.6 Different shipping charges may apply for sending particularly voluminous, heavy or high-valued products, which we indicate on the product detail page and on the order page of each individual product at the time of sale.

3. PAYMENT
3.1 We generally accept credit/debit card, Apple Pay and Paypal as payment methods. We reserve the right to refuse some payment methods and to request different payment methods. Please be aware that we only accept payments from Swiss and domestic European Union (EU) bank accounts and that any costs associated with the transaction are on charge to you.
3.2 If the items in the cart are not fully paid, the order will not be accepted by madeby.chiara production.

4. USE OF PROMOTIONAL COUPONS
4.1 Promotional vouchers cannot be purchased, are offered by us as part of promotional campaigns, and can be used for a limited period of validity.
4.2 Promotional vouchers may be used only once in relation to a single order, within the specified period of validity. The possibility of using promotional vouchers may be excluded for the purchase of certain products. Promotional vouchers cannot be used for the purchase of gift vouchers. It is possible that the use of a promotional voucher may be subject to a minimum spending amount.
4.3 The value of the products purchased must be equal to or above the value of the promotional voucher. If the amount of the promotional voucher is insufficient to cover the value of the products ordered, the difference may be paid for by any of the accepted methods of payment. Promotional vouchers are not redeemable for cash and no interest will accrue on the credit they represent. Promotional vouchers will not be refunded if the purchaser decides to return part or all of the products ordered.
4.4 Promotional vouchers can only be used if the order is finalized, they cannot be used retroactively, and they cannot be transferred to third parties. Unless otherwise provided, several promotional vouchers cannot be accumulated for the same order.
4.5 If in the course of the order the customer has used a promotional voucher and if the total value of the order - due to the customer's withdrawal - should be less than the value of the promotional voucher, we reserve the right as of now to invoice the original price of the goods remaining in the possession of the customer.

5. USE OF GIFT CARDS
5.1 Gift cards can be purchased, and can only be used for the purchase of madeby.chiara products but not for the purchase of additional gift cards. If the value of the gift cards is insufficient to cover the value of the products ordered, the difference may be paid by any of the accepted methods of payment.
5.2 Gift cards can only be used before the order is placed, they are not refundable in cash and no interest accrues on the credit they represent.

6. SHIPMENT
6.1 Domestic shipments are entrusted to Swiss Post via "A" shipping.
6.2 International shipments are entrusted to a private courier company.
6.3 Madeby.chiara will send a confirmation email once the shipment is completed with the tracking code, if provided, for both domestic and international shipments.
6.4 Madeby.chiara disclaims any responsibility for shipping since the products are entrusted to the postal service or a courier. In case of loss and/or damage during a shipment, madeby.chiara assumes no responsibility.

7. RIGHT TO RETURN OR SUBSTITUTION OF MADEBY.CHIARA PRODUCTS
7.1 For all purchases of madeby.chiara products made on www.madebychiara.ch, madeby.chiara grants a right of return or substitution in the event that the size is unsuitable or the product is simply not to the customer's taste. "Custom" products cannot be returned or substituted as they are custom made for the specific customer.
7.2 For all purchases of madeby.chiara products made on www.madebychiara.ch, madeby.chiara grants an optional right of return or substitution equal in total to 30 days from receipt of confirmation of shipment of the goods by email. After that, you may withdraw from the contract by simply returning the goods to us no later than 30 days from the receipt of the confirmation of the shipment of the goods by email(beginning of the deadline on the day of receipt of the confirmation email). 
7.3 To make a return or a substitution you must send an email to info.madebychiara@gmail.com, forwarding the confirmation of the shipment of the order. 
7.4 Shipping costs are the responsibility of the customer.
7.5 The goods must be returned in the original packaging with the tag intact and still attached to the garment, the products must not be damaged in any way. If these conditions are not met, the return or substitution of the goods can be refused. 
7.6 The right of return or substitution does not exist in case of purchase of gift cards.
7.7 We will proceed to refund in case of return or to ship the substitute item in case of substitution only when we receive the product in the same condition as the sale. These operations could take up to 20 days after madeby.chiara receives the product.

8. REFUNDS
8.1 Refunds will be made to the payment method entered at the time of the purchase. If you used a gift card for your purchase, we will credit the corresponding amount to promotional voucher.
8.2 Refunds will take up to 20 days.
